Unauthorized tree removal
Our office has handled numerous cases involving the unauthorized removal of trees from a client’s property. Sometimes, it’s an honest mistake as to the location of the property boundary, while other times, a logging company or adjacent landowner will recklessly clear cut land that is not theirs. In Georgia, unauthorized removal of trees from someone else’s property is serious business.
Georgia law imposes strict liability on those who illegally remove trees or vegetation from someone else’s property, including treble (three times) the fair market value of any tree(s) cut, the cost of reasonable reforestation activities, and attorney’s fees/expenses of litigation. If the trespass was willful (i.e., the property boundaries were clearly marked at the time of the removal), you may be entitled to punitive damages.
If you find that someone has illegally removed trees from your property, the first thing you should do is preserve evidence, including taking measurements and photographs of any stumps or trunks left behind.
